Trademarks are signs used in trade to identify products.
Your trademark is the symbol your customers use to make your choice. This will set you apart from your competitors. If you register your trademark, you can protect it and use it.
In some countries, even if your trademark is not registered, you can support it as long as it is used. However, we strongly advise you to register it in order to get the best protection.
The only condition imposed on the registered trademark is that it must be clearly defined. Otherwise neither you nor your competitors will be sure of what it covers.
Trademark rights( trademark registration) are one of the branches of industrial property rights, which are also part of intellectual property rights. A trademark is the most important means of differentiating the sector between the goods and services of different companies, and its mission is expanding more and more every day than in the past. The trademark or trademark registration helps the consumer to choose the desired product, so that the consumer's cost of choosing the required product is significantly reduced. It also helps the trademark owner to identify and" create identity " for his goods or services and prevent possible fraud and abuse. Therefore, it is necessary to ensure the proper implementation of the law in a complete and accurate manner, both in order to respect the rights of the trademark holder and the rights of the consumer. The acquisition of rights arising from the ownership of a trademark (trademark registration) has a lower economic value if it is not effectively supported by the executive. The validity and value of the rights system arising from the ownership of the trademark ( trademark registration) depends on its viability, and it is possible to guarantee its implementation only by knowing exactly the violation of these rights and anticipating the appropriate executive mechanism to prevent the violation of these rights.
In order to register a trademark, the first step is to fully understand the classes listed, each of which can be registered. Trademark registration in more than one class will include a surplus fee. You can read the list of classes for trademark registration below.
If the Treaty of Paris was not ratified internationally in order to protect the trademark(brand) and some countries did not become members, the owner of the trademark(real or legal person) should individually submit a number of applications in the offices of different member countries in different languages by paying different costs and spending a long time.(Of course, now some of the Gulf countries and small neighboring countries like the UAE and Dubai, which are not members of the treaty, have to act from within that country. )
To this end, in order to facilitate the process of international registration of the brand and the study of the rights arising from it, a number of member states of the Paris Convention formed the International Union to protect industrial ownership in line with the said convention, in which they adopted the Madrid system as the directive for international registration of trademarks(trademark registration). These two treaties are the 1891 Madrid Agreement and the related protocol adopted in 1989, as well as the joint statute. The Madrid system currently has 85 members from countries and regional offices.
It should be noted that the application for international registration is only possible through the industrial property offices of the member states of the Madrid system and is subject to the registration of the brand in the country of origin.
To apply for international trademark registration in other countries, the trademark must first be registered in the country of origin. Therefore, domestic registration of trademarks in the country of origin is a prerequisite for international registration of trademarks in the member states of the Madrid system.
The application for international trademark registration is only possible through the Industrial Property Office. The first step in this is to fill out the trademark declaration form with the Industrial Property Office, which is responsible for registering trademarks. This application form should contain the details and specifications of the requested sign, such as the color, form and other specifications of the said sign. This form should also include a list of related goods or services according to the International Classification of trademarks, which the requested mark contains.
For more information on the documents required, to register a trademark and how to fill out the declaration form, you can consult the trademark registration experts of the company sohatos.
A trademark should be specific and distinctive so that consumers recognize the product by seeing it, as well as distinguish it from other trademarks and other products that are introduced with those trademarks. A trademark should not mislead or deceive the consumer or cause the destruction of Public Order or against good morals.
The rights granted to a trademark shall not necessarily be equal to the rights granted to another trademark. This is determined through the investigations carried out by the Trademark Office or as a result of the claim of third parties to similar rights.
Almost every country in the world registers and supports trademarks. each national or regional trademark registry office maintains a set of registered trademark information that includes full requested information for all registered, renewed, searches and objections by third parties. But the effect of recording these signs is limited to the country or territory in question.
In order to avoid the need to register trademarks separately in each of the national or regional trademark registration organizations, the World Intellectual Property Organization WIPO has developed a system for international trademark registration. The system is governed by the Madrid Agreement and protocol, which includes international registration of signs. Any person who is connected in a way (in terms of nationality, residence or establishment of an industrial or commercial enterprise) to a contracting party country and to one or both of these treaties may enjoy the benefits of international registration, which has an impact on all or some other member states of the Madrid system, by registering or applying for registration of his trademark in the Registrar of trademarks of that country.
